AMGEN Singelloop Breda
Article 1. Definitions
1. In these general terms and conditions, the following terms shall have the following meanings:
a. the Event: the race that is part of the Event to be organised by the Organiser on the first Sunday of the month of October in any year with the name: ‘De Bredase Singelloop’.
b.Participant: the natural person (m/f), not acting as an entrepreneur, who has registered for participation in the Event in a manner permitted by the Organiser.
c.Agreement: the agreement relating to the participant’s participation in the Event.
d. Organiser: The “Bredase Singelloop” Foundation, P.O. Box 9523, 4801 LM Breda (Chamber of Commerce S.41104417).
2. These general terms and conditions apply to the Agreement.
Article 2. Participating Company Teams
1. Companies have the opportunity to participate in teams. Participating companies can be:
a. Legal entities which are registered in the trade register of the Chamber of Commerce and Industry in the Netherlands or its foreign equivalent;
b.Companies, not being legal persons, which for more than six months immediately prior to the match day have been continuously registered in the trade register of a Chamber of Commerce in the Netherlands;
c.Public legal persons as referred to in Article 2:1 of the Civil Code.
2. The Organiser may decide in individual cases to allow companies or institutions that do not meet the aforementioned requirements to take part in the Event.
3. Each participating company shall participate in the Event with one or more teams. These teams may be mixed teams (m/f) or separate women’s or men’s teams. At the start of the Event, each team consists of a minimum of three and a maximum of five Participants.
4. The final team time is the average time of the first three finishers in the team. If fewer than three members of a team finish, that team will be disqualified.
5. The teams compete per distance for places 1, 2 and 3.
6. The disqualification of a team does not imply the disqualification of the members of the team concerned as individual Participants.
Article 3. Participation
1. Participation in the Event is only possible by a natural person, who on the day of the Event has reached at least the minimum age set by the Organiser. In the absence of such a determination, the recommended age of at least twelve years for the 5K, sixteen years for the 10K and eighteen years for the half marathon, as proposed by the Athletics Union (Atletiekunie), applies.
2. Participation in the Event is only open to runners and (fast) walkers. It is not permitted to participate in the Event by wheelchair, wheeler or other adapted vehicle. It is also not permitted to participate in the Event with a buggy, baby jogger or other baby transport device. Participants are not permitted to be accompanied by one or more persons on a bicycle or other means of transport, except with the explicit written permission of the Organiser. It is not permitted to bring dogs (on a lead or not) to the Event.
An exception to this rule is the Family Run, in which participants in wheelchairs or other adapted vehicles, race runners, participants with a buggy, baby jogger or other baby transport device as well as dogs (provided they are on a leash) may participate. These Participants will start last. Wheelers are not allowed at this event.
The Walking & Wheeling section also offers space for participants in wheelchairs or other adapted vehicles, race runners, participants with a buggy, baby jogger or other baby transport device and also offers the possibility of participation for wheelers.
3. The Participant may only take part in the Event if the participating company has completed the relevant registration form fully and truthfully, has paid the registration fee and if the participating company has agreed to these General Terms and Conditions. The Organiser reserves the right to cancel and delete entries of Participants with false personal data at any time.
4. If the Participant is unable to attend the Event, the paid Entry Fee will not be refunded.
5. If the Event cannot take place due to exceptional circumstances or force majeure (e.g. accidents, storms, attacks, pandemics, etc.), there will be no refund of the entry fee. An entry fee also includes any voluntary additional donation to the charity to which the Organiser has committed itself.
An exception to this is the Singelloop running shirt that you may have ordered. This shirt can be obtained by the Participant but no cash refund will be given.
6. The Match Organiser has the right to disqualify a Participant and ban them from participating in the Event. The medical staff also has the right to deny a Participant (further) participation in the Event.
7. Time registration (if applicable) will take place at 5K, 10K, 15K, 20K and the finish line, time limits (gross times) apply for these passage points. The maximum gross finishing time for the 5K is 70 minutes and for the 10K 1 hour and 30 minutes. The maximum gross finishing time for the half marathon is 2 hours and 30 minutes. Enforcement of these limit times is at the discretion of the Organiser.
8. A Participant who has been informed that he/she has exceeded the limit is disqualified. He/she no longer takes part in the run and must leave the course.
9. There will be a broom wagon driving behind the last Participant (who runs within the time limit).
10. The Organiser may decide to terminate, suspend or neutralise the Event prematurely during the Event on the basis of exceptional circumstances or force majeure. The Organiser may also decide to change the route to be run or the distance to be covered during the Event due to exceptional circumstances. In such cases, no refund of the entry fee shall be made.
11. A decision by the Organiser to cancel the Event shall not give rise to liability for reimbursement of any costs incurred by the Participants.
Article 4. Liability
h3>1. Participation is at your own risk. The Organiser is not liable for any damage, by whatever name, suffered by the participant as a result of participation, unless such damage is the direct result of deliberate intent, gross negligence or negligence attributable to the Organiser. This exclusion of liability also applies to serious types of damage, such as those resulting from injury or death.
2. If – notwithstanding the provisions in the first paragraph of this Article – liability of the Organiser for damages of the Participant must be assumed, the obligation of the Organiser to pay compensation for those damages will be limited to the amount that the insurer of the Organiser pays out in respect of those damages.
3. The Participant must be adequately insured against the risk of damage that he/she or a surviving relative may suffer as a result of his/her death, injury or illness as a result of participating in the Event.
4. The Participant declares himself aware of the fact that participation in the Event requires good health in a physical and mental sense. The Participant also declares that he/she meets this requirement and that he/she has adequately prepared for the Event through training and other means. The Organiser expressly advises the Participant to undergo a sports medical examination in connection with participation in the Event.
5. A medical passport is included on the back of each starting number. The Organiser explicitly advises Participants to fill in the requested details which may be important if the participant has to use medical assistance during the Event. The Organiser is not liable for any damage that the Participant may suffer as a result of not filling in this medical passport, or filling it in incompletely or incorrectly.
6. The Participant indemnifies the Organiser for damages suffered by third parties as a result of an act or omission attributable to the Participant in relation to the Event. The Participant must be adequately insured against the risk of liability for such damage.
7. Sponsor(s) of the Event and the municipality in which the Event takes place are excluded from liability on the same basis as the Organiser.
Article 5. Personal belongings
If the Organiser stores items belonging to the Participant for him/her during the Event – whether in return for payment or not – or if a Participant leaves behind items in an area whether or not managed by the Organiser – whether with the consent of the Organiser or not, the Organiser is not liable for damage caused by loss, theft, loss or damage etc. of those items.
Article 6. Privacy
1. By registering, the Participant grants permission to the Organiser and its partners for the publication of photographs, audio and video material etc. made during or around the Event, in which the Participant is visible or audible.
2. The personal data provided by the Participant will be included in a file. By entering into the agreement, the Participant grants the Organiser permission to use the personal data for the purposes described in the Organiser’s Privacy Statement.
3. By entering into the agreement, the Participant grants the Organiser permission to publish his name and competition results, for example by publication in daily or weekly newspapers and via the Internet.
4. A positioning mechanism is included in the timing chip. These are read at the time registration points and do not give a signal. In the virtual run, registration does take place via GPS tracking on the participant’s mobile phone. By registering, the Participant grants permission to the Organiser and its partners for the use of the location data, exclusively during the Event.
5. As of 25 May 2018, new European privacy rules of the General Data Protection Regulation (abbreviated: GDPR), in Dutch the Algemene verordening gegevensbescherming (abbreviated: AVG) apply. Organiser respects these privacy rules and acts in accordance with this legislation. In this regard, the most recent version of the Organiser’s Privacy Statement forms an integral part of these Terms and Conditions.
Article 7. Dispute settlement
Disputes between Participant and Organiser will – with the exclusion of the civil court – be settled by arbitration in accordance with the arbitration regulations of the Atletiekunie or, in the absence thereof, the regulations of the Netherlands Arbitration Institute. A dispute exists if either party declares that this is the case. The Agreement, these General Terms and Conditions and all legal relationships that may arise between the Organiser and the Participant are governed exclusively by Dutch law.
Article 8. Competition Rules
Participation in the Event is subject to the current competition rules of the Atletiekunie, which form part of these General Terms and Conditions. The rules for the competitions to be organised by the Atletiekunie are determined by the Board and described in the competition rules. Amendments to the rules of World Athletics (formerly IAAF) or European Athletics shall take effect without further decision on the date determined by the federation concerned. The same applies to the section on Masters Athletics, where the competition rules of the World Masters Athletics (WMA) and European Masters Athletics (EMA) are concerned.
Article 9. General rules of conduct
1. Instructions from the Police, Competition Management, Event Supervision and staff must be followed immediately and promptly. Participants must also follow the indicated approach route. Failure to follow instructions may result in disqualification.
2. The Road Traffic Act and the Road Traffic and Traffic Signals Regulations will remain in full force during the run, unless explicitly stated otherwise in those situations in which the Organiser has been granted an exemption.
3. In the start/finish area, along the route and on the route to the start/finish area, flyers, sampling and other promotional activities are prohibited, unless explicitly promised by the Organiser prior to the Event.
4. Each participant is expected not to damage nature or other people’s property and not to leave any rubbish behind.
Article 10. Final provision
If one or more articles of these terms and conditions should be invalid or unlawful for any reason, this shall not affect the validity of the remaining parts of the terms and conditions.
